Renegociar o cr\u00e9dito \u00e0 habita\u00e7\u00e3o pode ser um passo importante para atenuar os aumentos. Prevendo-se que esta tend\u00eancia se mantenha, o Governo aprovou algumas <a href=\"https:\/\/www.portugal.gov.pt\/pt\/gc23\/comunicacao\/noticia?i=aprovado-decreto-lei-que-regula-a-renegociacao-dos-creditos-a-habitacao\" target=\"_blank\" rel=\"noreferrer noopener\">medidas<\/a> espec\u00edficas para quem tem um empr\u00e9stimo da casa.&nbsp;<\/p>\n\n\n\n<p>O objetivo \u00e9 que as pessoas continuem a ter capacidade de pagar a <strong>mensalidade <\/strong>e n\u00e3o entrem em <a href=\"https:\/\/gocredito.pt\/en\/blog\/incumprimento-credito-habitacao\/\" target=\"_blank\" rel=\"noreferrer noopener\">incumprimento banc\u00e1rio<\/a>. Com o custo de vida a aumentar, nomeadamente nos produtos e servi\u00e7os essenciais, esta \u00e9 uma forma de proteger o <strong>direito \u00e0 habita\u00e7\u00e3o<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Para quem tem ou pretende adquirir um empr\u00e9stimo para a casa, saber mais sobre estas medidas \u00e9 muito importante. De seguida, explicamos-lhe os pontos de interesse para quem quer renegociar o cr\u00e9dito \u00e0 habita\u00e7\u00e3o.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Medidas em vigor at\u00e9 ao final de 2023<\/strong>&nbsp;<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1. Avalia\u00e7\u00e3o da taxa de esfor\u00e7o acima dos 36%&nbsp;<\/strong><\/h3>\n\n\n\n<p>At\u00e9 ao final de 2023, os bancos v\u00e3o ter que se mostrar dispon\u00edveis para renegociar o cr\u00e9dito \u00e0 habita\u00e7\u00e3o com os clientes e fam\u00edlias que apresentem uma taxa de esfor\u00e7o superior a 36%. Esta medida abrange os contratos para <strong>casa pr\u00f3pria e permanente<\/strong>, com <strong>taxa de juro vari\u00e1vel<\/strong> e montante de empr\u00e9stimo <strong>at\u00e9 300 mil euros<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Com este cen\u00e1rio, a renegocia\u00e7\u00e3o do cr\u00e9dito \u00e0 habita\u00e7\u00e3o pode avan\u00e7ar perante uma de tr\u00eas situa\u00e7\u00f5es:&nbsp;<\/p>\n\n\n\n<p>\u27a2 A taxa de esfor\u00e7o cresce 5% relativamente ao per\u00edodo hom\u00f3logo (ou \u00e0 data da contrata\u00e7\u00e3o do <a href=\"https:\/\/gocredito.pt\/en\/blog\/credito-habitacao-requisitos\/\" target=\"_blank\" rel=\"noreferrer noopener\">cr\u00e9dito \u00e0 habita\u00e7\u00e3o<\/a>, no caso de ter sido celebrado nos \u00faltimos 12 meses) e ultrapassa os 36%;&nbsp;<\/p>\n\n\n\n<p>\u27a2 A Euribor subiu mais de 3% em rela\u00e7\u00e3o ao que foi considerado aquando da contrata\u00e7\u00e3o do empr\u00e9stimo, sendo que da\u00ed resulta uma taxa de esfor\u00e7o acima dos 36%;&nbsp;<\/p>\n\n\n\n<p>\u27a2 A taxa de esfor\u00e7o passa os 50% (nestes casos n\u00e3o \u00e9 necess\u00e1rio fazer a compara\u00e7\u00e3o com situa\u00e7\u00f5es passadas).&nbsp;<\/p>\n\n\n\n<p>Cabe \u00e0s institui\u00e7\u00f5es banc\u00e1rias fazerem o acompanhamento da taxa de esfor\u00e7o dos clientes. Caso sinalizem alguma situa\u00e7\u00e3o, devem contactar o cliente 60 dias antes da atualiza\u00e7\u00e3o da taxa contratada (3, 6 ou 12 meses). Mas tamb\u00e9m pode ser o cliente a pedir a renegocia\u00e7\u00e3o.&nbsp;<\/p>\n\n\n\n<p>Se tem um <a href=\"https:\/\/gocredito.pt\/en\/blog\/emprestimo-casa\/\" target=\"_blank\" rel=\"noreferrer noopener\">empr\u00e9stimo da casa<\/a>, \u00e9 poss\u00edvel que o seu banco solicite alguns documentos e informa\u00e7\u00f5es de modo a aferir esta quest\u00e3o. Caso isso aconte\u00e7a, tem um prazo de 10 dias para disponibilizar os dados solicitados.&nbsp;<\/p>\n\n\n\n<p>The <strong>Decreto-Lei<\/strong> prev\u00ea san\u00e7\u00f5es para as institui\u00e7\u00f5es banc\u00e1rias que n\u00e3o cumpram as regras para renegociar o cr\u00e9dito \u00e0 habita\u00e7\u00e3o. Mediante tais situa\u00e7\u00f5es, as coimas podem ir dos 3 mil aos 1,5 milh\u00f5es de euros.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quais as solu\u00e7\u00f5es para quem quer renegociar o cr\u00e9dito \u00e0 habita\u00e7\u00e3o?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Quando a institui\u00e7\u00e3o banc\u00e1ria deteta a subida da<strong> taxa de esfor\u00e7o<\/strong> ou o cliente demonstra que h\u00e1 um agravamento da sua<strong> <\/strong>condi\u00e7\u00e3o financeira, podem se negociadas as seguintes propostas:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Alargar o prazo do cr\u00e9dito \u00e0 habita\u00e7\u00e3o, no limite imposto pelo Banco de Portugal, durante um per\u00edodo m\u00e1ximo de cinco anos (altura limite para retomar o prazo original);&nbsp;<\/li>\n\n\n\n<li>Fixar um <strong>per\u00edodo de car\u00eancia<\/strong> de pagamento de capital;&nbsp;<\/li>\n\n\n\n<li>Diferir parte do capital para o fim do empr\u00e9stimo;&nbsp;<\/li>\n\n\n\n<li><strong>Reduzir a taxa de juro<\/strong> durante um per\u00edodo de tempo acordado com o banco;&nbsp;<\/li>\n\n\n\n<li>Refinanciar ou <a href=\"https:\/\/gocredito.pt\/en\/blog\/consolidar-credito\/\" target=\"_blank\" rel=\"noreferrer noopener\">consolidar cr\u00e9dito<\/a>;&nbsp;<\/li>\n\n\n\n<li><a href=\"https:\/\/gocredito.pt\/en\/blog\/transferir-credito-habitacao\/\" target=\"_blank\" rel=\"noreferrer noopener\">Transferir o cr\u00e9dito \u00e0 habita\u00e7\u00e3o<\/a>.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>At\u00e9 31 de dezembro de 2023, ficam isentos do pagamento de <strong>Imposto de Selo<\/strong> os clientes que, ao renegociarem o cr\u00e9dito \u00e0 habita\u00e7\u00e3o, optem pelo alargamento do prazo de pagamento, refinanciamento da d\u00edvida ou transfer\u00eancia de cr\u00e9dito.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2. Isen\u00e7\u00e3o da comiss\u00e3o de amortiza\u00e7\u00e3o<\/strong>&nbsp;<\/h3>\n\n\n\n<p>A segunda grande medida, em vigor at\u00e9 31 de dezembro de 2023, \u00e9 a isen\u00e7\u00e3o de pagamento de <a href=\"https:\/\/gocredito.pt\/en\/blog\/amortizar-credito-habitacao\/\" target=\"_blank\" rel=\"noreferrer noopener\">comiss\u00e3o de amortiza\u00e7\u00e3o<\/a>. Este benef\u00edcio abrange apenas os cr\u00e9ditos \u00e0 habita\u00e7\u00e3o com taxa vari\u00e1vel.
